Athletics: Marathoner Soh Rui Yong loses two of three appeals, must pay Ashley Liew $10,000 for costs

SINGAPORE - The Republic's top marathoner Soh Rui Yong has been ordered to pay costs amounting to $10,000 to former national teammate Ashley Liew after two of his appeals relating to an ongoing defamation suit filed by the latter were dismissed by the High Court. A third appeal, however, was allowed.

One of the two dismissed appeals was against the January dismissal of an application Soh had made for District Judge Lee Li Choon to recuse herself from the case because of alleged bias.

In her written judgment on Friday (April 30), Justice Valerie Thean noted that "this was the most substantive" of the three appeals in respect of costs.

The other dismissed appeal was against Judge Lee's dismissal of Soh's application in September 2020 for the late adduction of additional expert evidence.

The appeal by Soh that was allowed by Justice Thean relates to Judge Lee allowing Liew to amend his statement of claim, which is no longer allowed.

Learning point - always slow down during a race to let slower runners catch up, who knows, uncle also can win the Fair Play medal.... mah chong, let others chong faster..likedat then can show....how better to be a shiok shiok runner...not as a slow slow runner...otherwise, uncle will sue you for defamation...$,$$$,$$$😄

Unfortunately, it is probably not as simple as Uncle has put it.

Sure, money and more importantly, reputation is at stake. And also perhaps the credibility of a National Sports Association who supported Ashley in the first place. 

One thing is beyond dispute though - Soh is definitely the better marathoner. :crazysmile:

uncle does not see any evidence of a National Sports Association (SA) who supported Ashley in the first place, unless you are referring the SNOC?

What is not known in this High Court case, is why Expert Evidence (like calling an Expert Witness) is not allowed and was rejected. Money and more importantly spent for High Court case is very very expensive for the purpose to know the truth. Perhaps, SOH's Legal Team must have been "surprised" by Judge Lee's decision on the Rejection and Appeal to have an Expert Witness.

Yeah. Confused between SA and SNOC and which body it was that nominate Ashley in the first place. 

If it was SNOC, then its even worse. 

And the result of the case will be closely watched by the local sports fraternity. And like I said, the implication could be more far-reaching that some of us might realise (or even care)

If I understand Soh's recent post correctly, the need for an expert witness was because of Ashley's testimony on the stand during cross-examination.

From a layman's POV and reading through the press reports and some of the courts documents posted publicly, there can only be one conclusion. 

But of cos, I am no law expert and there may be other considerations beyond the understanding of a layman like myself. 

Soh's life (up to this point) is actually quite fascinating. An talented film maker will definitely be able to make a compelling documentary about his life. A 'more creative' one will be able to put a conspiratorial spin on it. :crazysmile:

Actually, given the chance if the "truth of the matter" is discovered on SOH's legal side - WIN with Expertise Witness, and the Judge decided for IT (WIN), then someone in the "National Sports Authority" will have to look very....you can fill-in the dots.

Again, speculations on what went on within the close door sessions of Court Chambers, it looks like SOH needs to tread carefully on his recent successful life track to *A Successful Career, *An International Brand Ambassador, *A GF (ready) for Marriage and Family, and *A Personal Political Preference/Alliance.

Apparently, there was some procedures which SOH's current Legal Team was not able to get the Judge Lee to Agree. Judge Lee's Disapprove on the Expert Witness was a blow to SOH's Court Case.

Also note Among many other things...

1) Judge Lee had allowed Ashley Liew's legal team to introduce 157 pages of particulars to his Statement of Claim. We made an appeal to the High Court against this unusual occurrence, and the High Court duly overturned this decision by Judge Lee. A win for us , with costs payable from Ashley to me. I am very happy with this result.

The stake will be higher for Ashley Liew, because SOH has acted as both defendant and plantiff...

    • uncle happened to come across this event...150KM or if closer to 160KM (100 miles)...     open till end of 2021...😄 same theme with Round Singapore or Around Singapore or Singapore Round Island.. As long as this is Virtual, Anytime Anyplace, realistically, can you even cover 10KM Challenge or more per day? uncle can. 50KM/160KM is 100 Miles, can you cover in 2 weeks? uncle can. 500KM, can you cover in 2 months? uncle can cover in 1 month. 2,021KM in 1 year? uncle can cover 6,000KM in 1 year. This is just Quantity in Distance Challenge lah...simply if you are registered in SCSM Virtual Club, simply participate in these weekly challenges and virtual races for free, you are motivated to be in the Leaderboard Ranking for free. like what uncle did in April with other 10K VR members who started to accummulate their distances and points...till the last day of the month.. Whether Team Challenge for 100 members or more to do 1680KM...you just need 3 Koh Papa <FOC> to achieve and accomplish...Bronze level. Aiya, uncle already rewarded self with this one... because this is achievable in 2021...and wish there was a Medal for 7,000KM. Now that will be a Real Challenge for uncle. That Challenge will be good enough for GOLD level for this event, right? 🤣
    • @sandy620, message uncle if you are interested, we can talk freely there, for sure, uncle is interested to form a team...for 300 members...do you really need so many? more like for good enough to gather school kids since school holidays are coming... Sad to say, here we have a lots of event thread starters, race recommendations, race reviewers (past and present) not much of participants in running except uncle and a few runners who can do beyond 16km...because of Covid-19, all races are cancelled, so motivation is curbed, and outdoor activities are "not as active as before". maybe you and uncle can do 1680KM... already uncle said monthly 700km, and how many then can you contribute as the other member?..maybe we need only 4-5 members. btw, local virtual races/challenges do not have really appealing to uncle, like sponsor is who? Local fee in SGD price, uncle could look overseas races for more affordable value.. like...for $30++....NB running tee (black), NB finisher tee (white), participant's medallion, a poncho... just need for 42KM... Seoul Marathon 2021...so cool...no idea what is offered for round Singapore one...uncle got high expectation one..😄 uncle is currently exploring Sao Paulo, Brazil...will let all know next time... As uncle has said, PM uncle on your interest...uncle does not talk much, just execute and show results...completes and finishes... 😄
